CDCAN: LEGISLATURE FINISHES WORK ON BUDGET – PASSES MAIN BUDGET BILL AND ALSO 16 BUDGET TRAILER BILLS IMPACTING IHSS/SLS OVERTIME, CHILD CARE, MEDI-CAL, EARLY START ELIGIBILITY RESTORATION, PACE PROVIDER INCREASES

SACRAMENTO, CA (CDCAN – LAST UPDATED 06/15/2014  09:15 PM) – The California Legislature completed final action on the state budget, passing earlier the main budget bill, SB 852, and later in the evening, final passage of 16 budget trailer bills. 
    The Assembly, which convened just after 4 PM Sunday afternoon, completed action on all budget related bills and adjourned at 7:04 PM.  The Senate, which convened around 5:40 PM Sunday, adjourned at 9:05 PM.
    As previously reported by CDCAN, the Legislature passed at 6:19 PM Sunday evening, the main budget bill, 2014-2015 State Budget authorizing $108 billion in State general fund spending in floor sessions that were conducted without acrimony and largely without long debate. The main budget bill was sent immediately to the Governor for expected approval. 
    The Assembly approved the main budget bill, SB 852 on a party-line vote of 55 to 24. The State Senate, also on a party-line vote, approved the main budget bill, SB 852 by vote of 25 to 11.
     The main budget bill and budget trailer bills passed by the Legislature today reflect the budget deal reached earlier this week by Governor Edmund G. “Jerry” Brown, Jr. and Democratic legislative leaders Senate President Pro Tem Darrell Steinberg (Democrat – Sacramento, 6th State Senate District) and Assembly Speaker Toni Atkins (Democrat – San Diego, 78th Assembly District).      
 
BUDGET TRAILER BILLS PASSED INCLUDING IHSS
    The Legislature also approved in addition to the main budget bill, 16 budget related bills – referred to as “budget trailer bills” – including SB 855 dealing with human services including provisions to implement overtime pay, beginning January 1, 2015, for In-Home Supportive Services (IHSS) workers, to comply with the new federal Department of Labor overtime regulations.
    Similar increases in funding for the federal overtime requirements was included in the developmental services trailer bill (SB 856) for other home care services (supported living services, in-home respite and personal attendants).
    Other budget trailer bills included provisions that restored eligibility to the State’s early intervention for infants and toddlers, called “Early Start”, to what it was prior to the 2009 reductions; increase in rates for providers in Child Care and Development, providers in the Program of All Inclusive Care for the Elderly – known as PACE, and an increase next year in grants for CalWORKS recipients. 
    The budget related bills are called “budget trailer bills” because they follow or trail the main budget bill to make necessary changes or additions to State law to implement how the funding will be spent in the main budget bill. 
    CDCAN will issue report later on details on what is in the budget plan. 
 
NEXT STEPS
    TODAY:  The main budget bill (SB 852) heads immediately to the governor, beating the State Constitutional deadline requiring the Legislature to pass a budget by the end of June 15th and send it to the Governor.  (The deadline does not apply to the Governor to sign or veto it however. The end of the State’s budget year is June 30th
    WITHIN NEXT FEW DAYS OR SOONER: The Governor, because the spending plan reflects the budget agreement, is certain to sign the main budget bill likely within the next few days or sooner.  However the Governor will likely use his blue pencil “line item veto” power to delete or reduce funding in some budget areas, though probably not in the major areas included specifically in the budget deal or nor likely as extensively as he has done in the past.
    WITHIN NEXT TWO WEEKS: All budget trailer bills passed by the Legislature will be eventually placed on the Governor’s desk for his approval (the June 15th deadline applies only to main budget bill). The process can take sometimes several weeks to allow for time for each bill to go through a final drafting stage to prepare it for signature of the Governor called “enrollment”.

CDCAN COMMENT: The main budget bill has the actual funding numbers for every program and department funded or authorized funding through the State. It also contains what is referred to as “budget bill language” or “BBL” which is different from “budget trailer bill language” in that the language in the main budget bill is only good for that budget year, and generally the language only provides an explanation of the funding or some specific reporting requirements.
